Terms of Service

1. Acceptance of terms

By creating an account or using PCAP Analyzer (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are accessing the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.

These Terms apply alongside our Privacy Policy, which forms part of our agreement with you.

2. Definitions

  • "PCAP Lab," "we," "us," "our" — pcaplab.com, the operator of the Service.
  • "Service" — the PCAP Analyzer web application accessible at this domain, including all features, APIs, and documentation.
  • "Account" — the user account created by registering on the Service.
  • "Subscription" — a paid or free tier of access to the Service.
  • "PCAP File" — a network packet capture file (formats: .pcap, .pcapng) that you upload for analysis.
  • "Report" — the HTML or JSON analysis output generated by the Service from a PCAP File.
  • "User Content" — all PCAP Files and any other data you submit to the Service.
  • "Consumer" — a natural person acting for purposes outside their trade, business, or profession.

3. Service description and subscription plans

PCAP Analyzer is a network traffic analysis tool that accepts PCAP files uploaded by users, performs automated TCP, DNS, and network latency analysis, and returns an analysis Report.

All prices are exclusive of applicable VAT or sales tax, which will be added at checkout where required. Plan features may be updated. We will give at least 30 days' notice of any reduction in features for existing paid subscribers.

4. Account registration

To use the Service you must create an account using a valid email address, a username, and a strong password meeting our minimum requirements. New public accounts are active immediately, but uploads require email verification.

You agree to:

  • Provide accurate, truthful, and current registration information.
  • Keep your account credentials confidential and not share them with any third party.
  • Notify us promptly at contact@pcaplab.com if you suspect any unauthorised access to your account.
  • Not create more than one account per individual or organisation without our prior written consent.

You are responsible for all activity that occurs under your account. PCAP Lab is not liable for any loss resulting from your failure to secure your account credentials.

5. Subscription, pricing, and payment

Paid subscriptions (Pro) are billed monthly in advance. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

Payment processing: Payment is handled by a third-party payment processor. We do not store or process payment card data directly. Billing is not enabled in the development service. Before paid production checkout is activated, the active payment processor and its applicable terms will be identified in these Terms and in the sub-processor list.

Failed payment: If payment fails, we will retry the charge and notify you by email. After a 7-day grace period, your account will be downgraded to the Starter plan and you will lose access to paid plan features until payment is settled.

Price changes: We will give at least 30 days' advance notice of any price increase. Continued use of the Service after the effective date of a price change constitutes acceptance of the new price.

Refunds: Subscription fees are non-refundable except as required by applicable law or as expressly stated in this Section.

6. Free trial

Pro plans include a 14-day free trial. One free trial is permitted per email address across all paid plans. At the end of the trial:

  • Your account enters a 7-day grace period during which you can view existing reports but cannot submit new PCAP files for analysis.
  • At the end of the grace period, your account is automatically downgraded to the Starter plan.
  • To maintain paid plan access, activate a subscription before the trial expires.

7. Cancellation and right of withdrawal (EU Consumers)

7.1 Cancellation by the user

You may cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the unused portion of a billing period unless required by applicable law. Upon cancellation, your account reverts to the Starter plan. Your existing reports will remain accessible according to Starter plan retention (7 days from their creation date).

To cancel, use the cancellation option in your account settings. A prominent cancellation link labelled "Cancel my subscription" is accessible from your account dashboard at all times, in compliance with EU Consumer Rights Directive requirements effective June 2026.

7.2 EU statutory right of withdrawal (14-day cooling-off period)

If you are a Consumer (a natural person contracting for purposes outside your trade or profession) within the European Union, European Economic Area, or United Kingdom, you have a 14-day right of withdrawal from a new paid subscription, beginning on the day the subscription contract is concluded, without giving any reason (Consumer Rights Directive 2011/83/EU and equivalent national implementing legislation).

Waiver of withdrawal right for digital services: When you subscribe to a paid plan, you will be asked to confirm by an active checkbox at checkout: "I request immediate access to the Service and I acknowledge that, by beginning to use the Service, I waive my 14-day right of withdrawal in accordance with Article 16(m) of Directive 2011/83/EU." If you check this box and begin using the paid features, your right of withdrawal is waived. If you do not begin using the paid features, the 14-day right of withdrawal remains available.

To exercise your right of withdrawal before use begins, notify us within 14 days by email to contact@pcaplab.com with subject line "Withdrawal of Subscription" and your account email address. We will confirm receipt and process a full refund within 14 days to the original payment method. If you partially used the paid service before withdrawing, we may charge a pro-rata amount for the period of use.

EU Online Dispute Resolution: EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. Our contact email for ODR purposes is contact@pcaplab.com.

8. Acceptable use policy

8.1 Permitted uses

You may use PCAP Analyzer only for:

  • Network diagnostics, troubleshooting, and performance analysis on infrastructure that you own or are explicitly and lawfully authorised in writing to monitor.
  • Authorised security testing (penetration testing, vulnerability assessments) on systems for which you hold written engagement authorisation from the system owner.
  • Security research on systems, networks, or traffic captures that you have generated yourself or for which you hold appropriate legal rights.
  • Educational purposes using self-generated or lawfully licensed PCAP datasets.

8.2 Prohibited uses

You must not use the Service to:

  • Upload or analyse network captures from networks or systems you do not own and for which you do not hold explicit written monitoring authorisation.
  • Capture, analyse, or extract credentials, passwords, communications, or personal data belonging to individuals without their knowledge and consent.
  • Conduct mass surveillance, track individuals without consent, or create behavioural profiles of individuals using captured traffic.
  • Engage in or facilitate any activity that constitutes unauthorised interception of communications, which is a criminal offence in most jurisdictions (including under Directive 2013/40/EU on attacks against information systems, the UK Computer Misuse Act, and the US Computer Fraud and Abuse Act).
  • Upload PCAP files that you know contain payment card data (PCI DSS in-scope data), health records (HIPAA-protected health information), or similarly regulated special-category data, without obtaining and documenting the applicable authorisation and safeguards.
  • Use the Service to circumvent, test, or attack PCAP Lab's own infrastructure.
  • Attempt to bypass plan quotas, rate limits, or access controls.
  • Use automated tools, scripts, or bots to mass-upload files or scrape analysis results, except through any API we explicitly provide and document.
  • Resell, sublicense, or provide the Service as a white-labelled or embedded product to third parties without our prior written consent.
  • Attempt to reverse engineer, decompile, or extract source code from the Service.
  • Use the Service for any purpose that violates applicable law or regulation.

8.3 Enforcement

We reserve the right to suspend or permanently terminate any account that we reasonably believe is in violation of this Acceptable Use Policy, without advance notice and without refund. We will cooperate fully with competent law enforcement authorities investigating violations of applicable law facilitated through the Service.

9. Your content (PCAP files)

Ownership: You retain all ownership rights in the PCAP files you upload and the reports generated from them. We do not claim any ownership of your User Content.

License to us: By uploading a PCAP file, you grant PCAP Lab a limited, non-exclusive, non-transferable licence to store and process the file solely for the purpose of providing the Service to you (i.e., generating your analysis report). This licence terminates when the file is deleted according to the retention schedule in our Privacy Policy.

Your warranty: You represent and warrant that:

  • Any PCAP file you upload was lawfully captured on a network that you own or are explicitly authorised to monitor in writing.
  • You have complied with all applicable privacy, wiretapping, and data protection laws with respect to any personal data of third parties present in the capture file.
  • You have obtained any necessary consent from individuals whose communications may be present in the capture, or have a lawful basis under applicable data protection law for processing such data.

No monitoring of content: We do not inspect, review, or screen PCAP file contents beyond what is technically required to perform the analysis (packet parsing, statistical analysis, protocol decoding). We do not read, store, or disclose the payload data contained in your PCAP files.

10. Intellectual property

PCAP Analyzer, including its software, design, interface, analysis algorithms, and documentation, is the exclusive intellectual property of PCAP Lab (or its licensors) and is protected by copyright, database rights, and other applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the duration of your Subscription and solely for the purposes permitted by these Terms. No other rights are granted. All rights not expressly granted are reserved.

You must not copy, reproduce, distribute, modify, create derivative works of, disassemble, decompile, or reverse engineer any part of the Service.

11. Service availability and disclaimers

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or continuously available access to the Service.

Free tier (Starter): The Starter plan is provided without any uptime commitment or service level agreement.

Paid tiers (Pro): Service level targets will be defined at general availability of the paid plans. Until a formal SLA is published and incorporated into these Terms, no uptime guarantee applies.

Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of analysis results, or non-infringement. Analysis reports are informational outputs based on automated processing; they do not constitute professional network engineering advice. You should independently verify material findings before taking action.

EU Consumer note: Nothing in this disclaimer affects your statutory rights as a Consumer under applicable EU law.

12. Limitation of liability

To the maximum extent permitted by applicable law:

  1. Exclusion of certain losses: PCAP Lab is not liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of data, loss of business, or reputational harm, arising out of or in connection with the Service, even if advised of the possibility of such damages.
  2. Cap on liability: PCAP Lab's total aggregate liability to you for any and all claims arising out of or in connection with the Service shall not exceed the greater of: (a) the total fees you paid to PCAP Lab in the three months preceding the event giving rise to the claim, or (b) €100.
  3. Free tier: Where you use the Service under the Starter (free) plan, PCAP Lab's total aggregate liability shall not exceed €50.

EU Consumer note: Nothing in this Section limits or excludes PCAP Lab's liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be limited or excluded under applicable Consumer protection law.

13. Indemnification

You agree to indemnify, defend, and hold harmless PCAP Lab, its officers, directors, employees, and agents from and against any claims, liabilities, damages, fines, penalties, and costs (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms or the Acceptable Use Policy.
  • Your unlawful or unauthorised capture or upload of network traffic.
  • Your violation of any applicable law, including data protection, wiretapping, or computer crime laws.
  • Any third-party claim that your User Content infringes their rights.

14. Termination

14.1 Termination by you

You may close your account at any time by contacting us at contact@pcaplab.com. Account closure will take effect within 5 business days. [Self-service account deletion will be implemented before public launch.]

14.2 Termination by PCAP Lab

We may suspend or terminate your account, with or without notice, if:

  • You violate these Terms or the Acceptable Use Policy.
  • You fail to pay subscription fees after the applicable grace period.
  • We are required to do so by law or a regulatory authority.
  • We discontinue the Service (30 days' advance notice will be provided).

14.3 Effect of termination

Upon termination for any reason, your right to access and use the Service ends immediately. All PCAP files and reports associated with your account will be permanently deleted within 30 days of termination. Provisions of these Terms that by their nature should survive termination (including Sections 9, 10, 12, 13, 15, 16, and 17) will continue to apply.

15. Data protection and privacy

The collection and processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Users who upload PCAP files containing personal data of third parties may request our standard Data Processing Agreement (DPA) by emailing contact@pcaplab.com.

16. Modifications to these Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice via email to your registered address and/or a prominent notice within the Service before the new Terms take effect. For non-material changes (e.g., formatting, correction of typographical errors, or clarification without substantive change), we may update the Terms without advance notice.

If you object to any change, your remedy is to stop using the Service and, where applicable, cancel your subscription before the new Terms take effect. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.

17. General provisions

  • Entire agreement: These Terms, together with the Privacy Policy and any plan-specific addenda, constitute the entire agreement between you and PCAP Lab regarding the Service and supersede all prior negotiations, representations, or agreements.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
  • No waiver: Failure by PCAP Lab to enforce any provision of these Terms does not constitute a waiver of the right to enforce it in the future.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. PCAP Lab may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
  • Force majeure: Neither party is liable for failure to perform obligations due to causes beyond its reasonable control, including natural disasters, governmental action, or internet infrastructure failures.
